13 June 2022 Priya Vaidya 2373 Case Updates Begum v Secretary of State for the Home Department [2022] UKAITUR HU205022019 by Priya Vaidya The case: The appellant is a national of Pakistan. She arrived in the United Kingdom on 11 February 2019 with leave to enter as a visitor. On 23 July 2019, she applied for leave to remain. Her application was refused. Permission to appeal to the Upper Tribunal was granted. This was an appeal against the respondent's decision to refuse her application for leave to remain. The appellant’s case was that she came to the UK, accompanied by her son. However, the death of her husband had a deep impact on her and once in the UK, her health deteriorated. The appellant claimed she was now frail, tearful, forgetful and lonely, and had mental health issues such that she now required 24-hour care and supervision. She claimed she required help with dressing, bathing, cooking, walking, social interaction and administering medication. She claims that if returned to Pakistan, she would have insufficient support and would not be able to care for herself.
