Cloonan v The Health Service Executive [2022] IECA 129

The case: The plaintiff claimed that the death of his wife, Josephine, by suicide, was caused by negligence and breach of duty on the part of the Health Service Executive (the ‘HSE’) and Dr Kishan Browne, a psychiatrist. Judgment was given in favour of the Plaintiff and the HSE and Dr Browne brought this appeal because in their view, ‘a serious miscarriage of justice’ had occurred.
