08 August 2023 Wiebke Morgan 1673 Case Updates Sicwebu v Secretary of State for the Home Department [2023] EWCA Civ 550 byWiebke Morgan “The expert vindicated” The case: This appeal concerned the application of the "unduly harsh" test in the case of a foreign national offender, Mr Sicwebu, convicted of a serious criminal offence and subject to deportation in consequence. The appellant contended that Judge Hanson's decision was wrong in law because the judge erred in his treatment of the expert evidence. Submissions: As for the treatment of expert evidence, it was submitted in relation to the expert report of Tamara Licht, that Judge Hanson unfairly disregarded her report on the basis of "an issue for which Tamara Licht has been criticised by a judge of this Tribunal before" without providing any further details.
