EWI responds to Draft Practice Directions

The current Practice Directions were made in 2010 but since then the Tribunal has acquired additional jurisdictions and modified its ways of working.

 

The new draft takes these changes into account and includes new material including Expert Evidence.

 

The EWI welcomes the inclusion of the Practice Directions on Expert Evidence, but highlighted in their response that there could be greater alignment with CPR Part 35, Criminal PR Part 19 and Family PR Part 25 to avoid conflicts in guidance. In addition, we have made recommendations about additional clarity around Single Joint Experts and the ability of the Expert to seek clarification from the court.

 

We will be sure to let members know of the outcome of the consultation.
