09 June 2022 Priya Vaidya 796 Case Updates R v Nijhawan [2022] EWCA Crim 10 byPriya Vaidya The appeal: The applicant was convicted of the manslaughter of his wife on the grounds of diminished responsibility and sentenced to life imprisonment with a minimum term of 10 years. The application was for leave to appeal against sentence and to call fresh evidence from Professor David Healy to the effect that the medication for depression which the applicant was taking was capable of inducing suicidal and homicidal tendencies in people who would not otherwise be at risk of committing homicide or suicide and that there appeared to be a strong case that this medication compromised the applicant's functioning, causing or contributing to the killing of his wife.
