Expert Terms and Conditions of Engagement

We have just completed the regular review of our Standard Expert Terms and Conditions of Engagement by BEB Contract and Legal Services. The purpose of the Terms and Conditions is to help you ensure that you have appropriate contractual arrangements in place with the parties that instruct you. The key amendments are:

  • Clarifying that the Letter of Engagement may be used as part of the Expert Report (clause 2.5),
  • Adding a clause providing the expert with access to any relevant property/properties to carry out inspections and make enquiries (clause 3.2.5), and
  • Adding that charges may include the purchase of documents required for the provision of the Services, such as current British Standards regulations (clause 6.8). 

We recommend that all experts have robust Terms and Conditions in place. Along with the revised Terms and Conditions, we have our updated the Resource Guide. The Guide provides guidance on using the Terms and Conditions. However, it is open to you how you wish to use them. You could, for example, adopt the Terms and Conditions as they are, use them as a basis for terms and conditions customised to your specific circumstances, or as a touchstone against which to check the robustness of your current contractual arrangements.
