EWI Guidance on Acting for Litigants in Person

We have revised our recently published Guidance for experts on acting for litigants in person ('LiP'). After engagement with members, we have decided to amend our previous general advice to members only to act for unrepresented parties in exceptional circumstances. We now recommend instead that members should consider acting for an LiP but should exercise considerable caution before accepting instructions. This recommendation more appropriately balances the importance of facilitating access to justice while retaining appropriate safeguards for experts. 

Members should note that any agreement to accept instructions from an LiP is likely to require them to adopt significantly altered processes than would otherwise be appropriate. The Guidance provides advice on implementing these altered processes.
