ADR is likely to be increasingly used to resolve disputes following: the Court of Appeal judgment in James Churchill v Merthyr Tydfil Borough Council in which the court decided it could stay proceedings for, or order, the parties to engage in a non-court-based dispute resolution process, the subsequent amendments to the Civil Procedure Rules to promote the use of ADR, the enactment of the Arbitration Act 2025. You can find our new ADR resources at Knowledge Hub. And why not check out our recent case update Setting The Goal Posts in Expert Determination Cases For “Manifest Error” Exceptions which deals with a successful challenge of an expert’s decision in the context of a concession agreement for sporting events.
